The first draft of norm to legislate on Andalusia was the Federal Constitution of Antequera, drawn up in 1883, within the context of the cantonal struggle, proclaiming an independent state of Andalusia. The text never came into force but defended advanced democratic and social advances for its time.

With the birth of the Second Spanish Republic in 1931 the Draft Statute of the Autonomous Government of Andalusia was drafted, which would not be approved either since the Constitution of the Republic prevented any attempt to create a federal state.

It would not be until the Spanish transition, when Andalusia acceded to autonomy through the so-called "fast track" contained in article 151 of the Spanish Constitution of 1978. Following this procedure, the referendum of February 28, 1980 was held in Andalusia, if In view of the lack of support in Almería, we had to wait to see the Autonomous Community of Andalusia finally constituted on December 30, 1981, in which the long-awaited Statute of Autonomy was promulgated and sanctioned by the King, which states in Article 1 that Such autonomy is justified in the "historical identity, in the self-government that the Constitution allows all nationalities, in full equality to the rest of the nationalities and regions that make up Spain, and with a power that emanates from the Constitution and the Andalusian people reflected in their Statute of Autonomy ". It was the only Autonomous Community that plebiscited such access in a referendum.

Statute of Autonomy of 1981
The autonomous statute had its origin in a draft drawn up in Carmona in 1979 3 which in turn came from a previous agreement, the Antequera Pact. It was not until 1981 that a definitive version published by nine assemblymen of the ruling parties at that time would be released. The final project was approved on March 1 in Córdoba, in the Palacio de la Diputación.4 It was sent to the Cortes where it was reviewed and corrected and finally submitted to a referendum on October 20, 1981, where it won their approval. Two months later, on December 30, 1981, it was ratified by King Juan Carlos I.
