Having regard to Article 34 of the Constitution of 14 April 1962;
The Cabinet agreed at its meeting on,

Article 1. Criminal law is now governed by a new code, which is annexed to this
order.
Article 2. Article 29 of Ordinance No. 6 of 21 March 1967 on the reform of the judiciary is
amended as follows:
"In correctional matters, the magistrates with offenses listed below:
I. Offenses under the Criminal Code:
Article 30. Breach of decrees banishment.
II. Crime and offenses against the state:
Rebellion simple, sections 105, 106, and 110 al.1er;
Failure to pay the tax, Article 112;
Inciting refusal of the tax, Article 113;
Harboring criminals, section 114;
Refusal to answer the summons, section 115;
Opposition to the work of officials and agents of authority, Article 116;
Law violations burials, section 117;
Casualties of War, Article 119;
Escapes, sections 125 to 129;

III. Achievements and obstacles to public freedoms, peace, public tranquility:

Article 3. The texts of other codes, laws or regulations of any kind referring to the Penal Code
will be read and applied according to the correlation table in the Second Schedule to this Order.
Article 4 shall be repealed:
The Penal Code made applicable in A.E.F. by decree of 28 September 1897 and all amendments thereto
subsequent;
The decree of 28 May 1927 on the suppression of the preparation and administration of the poison says
test in A.E.F. ;
Article 66 of the Decree of 30 October 1935 for the Suppression of bad checks;
Law No. 15 of 13 November 1959 on the punishment of acts of resistance, disobedience and
shortcomings towards government members, MPs and administrative authorities and
court;
Law No. 12 of March 6, 1961 repressing attacks and plots against the life of the head of state and
Member of the Government and the National Assembly;
Articles 5, 6, 7, 8 and 9 of the order No. 46 of 27 October 1962 on the crowds.
Article 5. This Ordinance shall be published in the Official Journal, tabled in the assembly
national, in accordance with Article 34 of the Constitution and executed as state law.
