BY THE GRACE OF GOD ALMIGHTY
PRESIDENT OF THE REPUBLIC OF INDONESIA,

Weigh:

a. that in the framework of the implementation of the ideals of the nation and realize the goal of the State as stated in the preamble of the Constitution of the Republic of Indonesia Year 1945, needs to be built apparatus state civil integrity, professional, neutral and free from political interference, free from corruption, collusion and nepotism, as well as capable of carrying out a public service to the community and being able to perform the role as adhesive element of national unity based on Pancasila and the Constitution of the Republic of Indonesia Year 1945;

b. that the implementation of the civilian state apparatus management is not based on a comparison between competence and qualifications required by the office of the competence and qualifications of candidates for recruitment, appointment, placement and promotion in positions in line with good governance;

c. that the civilian apparatus to realize the state as part of bureaucratic reform, needs to be established as a state of civil apparatus profession has an obligation to manage and develop themselves and are obliged to account for its performance and apply the merit principle in the implementation of the civilian state apparatus management;

d. that Law No. 8 of 1974 on the Fundamentals of Employment as amended by Act No. 43 of 1999 on Amendments to the Law No. 8 of 1974 on the Fundamentals of Civil Service is not in accordance with the demands of the national and global challenges that need to be replaced;

e. that based on the considerations referred to in paragraphs a, b, c, and d need to establish the Law on State Civil Apparatus;
