The words "Source of Islamic Law 'is a translation of the wording Masâdir al-Ahkam. These words are not found in the books of Islamic law written by scholars of fiqh and usul classical fiqh. To explain the meaning of 'source of Islamic law', they use the al-al-Syariyyah is unfair. The use mashâdir al-Ahkam by scholars at the present time, of which the purpose is synonymous with the term al-Adillah al-Syar'iyyah. [2]

What is meant Masâdir al-Ahkam are legal arguments of Personality 'is taken (diistimbathkan) thereof to find the law'. [3]

Sources of law in Islam, there are agreed (muttafaq) the scholars and there are still dipersilisihkan (mukhtalaf). As for the sources of Islamic law are the agreed scholarly Quran, Hadith, Ijma and Qiyas. Scholars also agree with the order of the arguments mentioned above (Qur'an, Sunnah, ijma 'and Qiyas).

While the source of Islamic law which is still disputed among scholars in addition to the four sources of law above is istihsan, maslahah mursalah, istishâb, '' uruf, schools as-Shahabi, syar'u qablana man.
