With this simple application it is possible to calculate in one single step the legal and default interest in the course of the case, as foreseen by the art. 1284 c.c. amended in 2014, with the possibility of applying the monetary revaluation according to the well-known judgment of the Supreme Court (No. 1712 of 1995).

As is known, the art. 1284 c.c. it has been enriched by two new paragraphs (4 and 5) which provide ex lege the use of so-called default interest in the event that the creditor has started a legal process for the recovery of credit, interests which, as is known, are much higher compared to the legal rate.

The new provisions were introduced by art. 17, paragraph 1 of the D.L. 12/09/2014, n. 132, converted with amendments in Law 10/11/2014, n. 162, and have effect on the proceedings initiated starting from the thirtieth day from the entry into force of the conversion law, ie on the proceedings commenced on 11/12/2014.

NOTE: the application takes into account the terms of applicability of the new rules (Article 17, paragraph 2) for which, inserting a date prior to 11/12/2014 as the date of the judicial request, only legal interests will be applied.

Below is the text of the new paragraphs:
"If the parties have not determined the measure, from the moment in which the judicial request is proposed, the rate of legal interest is equal to that foreseen by the special legislation concerning late payments in commercial transactions.
The provision of the fourth paragraph also applies to the act by which the arbitration proceeding is promoted ".

In other words, the art. 1284 novellato clearly indicates that, in the absence of a contractually agreed rate between the parties, starting from the date on which the judgment was based, the same default interest rates as for delayed payments in commercial transactions must be applied (Legislative Decree 231/2002 and subsequent mod.).

The law also suggests that from the credit starting date until the start of the trial we must continue to apply the legal interests, as was the case before the introduction of the new paragraphs, and for this reason the application takes into account automatically using the correct reference rate: the legal interests before the court application and the default interest thereafter.

Finally, to cover all the cases covered by the aforementioned art. 1284, the application allows to indicate also a fixed rate to be used in case the rate of late payment has been agreed upon in the contract.
