The criminal legislation of the Republic of Kazakhstan consists of this Criminal Code of the Republic of Kazakhstan. Other laws providing for criminal liability shall be applicable only after their inclusion in this Code.
This Code is based on the Constitution of the Republic of Kazakhstan and generally accepted principles and norms of international law. The Constitution of the Republic of Kazakhstan has the highest legal force and direct effect on the entire territory of the Republic. In the event of a conflict between the provisions of this Code and the Constitution of the Republic of Kazakhstan, the provisions of the Constitution shall apply. The norms of this Code, recognized as unconstitutional, including infringing the rights and freedoms of a person and citizen enshrined in the Constitution of the Republic of Kazakhstan, lose their legal force and are not applicable. Regulatory decisions of the Constitutional Council and the Supreme Court of the Republic of Kazakhstan are an integral part of the criminal legislation of the Republic of Kazakhstan.
International treaties ratified by the Republic of Kazakhstan take precedence over this Code and are applied directly, except in cases where it follows from an international treaty that its application requires the issuance of a law.
The objectives of this Code are: protection of the rights, freedoms and legitimate interests of a person and citizen, property, rights and legitimate interests of organizations, public order and security, the environment, the constitutional system and the territorial integrity of the Republic of Kazakhstan, the legally protected interests of society and the state from socially dangerous attacks , protection of the peace and security of mankind, as well as the prevention of criminal offenses.
