The Criminal Code of the Republic of Kazakhstan consists of the Criminal Code of the Republic of Kazakhstan. Other laws requiring criminal liability shall be subject to application only after inclusion in this Code.
This Code shall be based on the Constitution of the Republic of Kazakhstan and universally recognized principles and norms of international law. The Constitution of the Republic of Kazakhstan has the highest legal force and is directly applicable throughout the Republic. In the event of contradiction between the provisions of this Code and the Constitution of the Republic of Kazakhstan, the provisions of the Constitution shall apply. The norms of this Code, which are recognized as unconstitutional, including the rights and freedoms of the person and citizen established by the Constitution of the Republic of Kazakhstan, shall be abrogated and shall not be subject to application. Normative resolutions of the Constitutional Council and the Supreme Court of the Republic of Kazakhstan are an integral part of the criminal legislation of the Republic of Kazakhstan.
The international treaties ratified by the Republic of Kazakhstan shall be preceded by this Code and shall be applied directly to the international agreement, except where the international treaty requires the application of the law.
The objectives of this Code are: protection of the rights, freedoms and legitimate interests of the person and the citizen, the rights and legitimate interests of organizations, public order and security, the environment, the constitutional order and territorial integrity of the Republic of Kazakhstan, legally protected interests of the society and the state from the danger of social danger; and human security, as well as prevention of criminal offenses.
In order to carry out these tasks, the Code establishes the grounds for criminal liability, identifies what acts, which are dangerous for an individual, society or the state, are criminal offenses, ie crimes or criminal offenses, punishments and other criminal-law measures shall be taken.
