Constitution of the Republic of Indonesia Year 1945 confirms that Indonesia is a country of law. In line with these provisions, the one important principle of state of law is the guarantee of the implementation of independent judiciary, free from the influence of other powers to organize judicial administration to uphold the law and justice. Article 24 paragraph (1) of the Constitution of the Republic of Indonesia Year 1945 confirms that the judicial power is an independent power to organize judicial administration to uphold the law and justice.


Changes in the Constitution of the Republic of Indonesia Year 1945 has brought a change in the constitutional life, especially in the implementation of judicial power. Those changes, among others, confirms that:

- Conducted by a judicial authority of the Supreme Court and judicial bodies underneath it in the general courts, religious courts, military courts, administrative courts, and by a Constitutional Court.
- The Supreme Court has authority to hear the appeal, examine the legislation under the law against the law, and have other powers provided by law.
- The Constitutional Court is authorized to test laws against the Constitution of the Republic of Indonesia Year 1945 and rule on the dispute the authority of state institutions whose authorities are granted by the Constitution of the Republic of Indonesia Year 1945.
- The Judicial Commission is authorized to propose the appointment of justices and have the authority to another in order to preserve and uphold the honor, dignity, and the behavior of judges.

Basically Act No. 4 of 2004 on Judicial Power in accordance with changes in the Constitution of the Republic of Indonesia Year 1945 on top, but the substance of the Act have not been set in a comprehensive manner on the implementation of the judicial power, which is an independent power which is done by a Supreme Court and judicial bodies underneath it in the general courts, religious courts, military courts, administrative courts, and by a Constitutional Court, to organize judicial administration to uphold the law and justice.

In addition to a comprehensive arrangement, the Act is also to fulfill the decision of the Constitutional Court Number 005 / PUU / 2006, which one has canceled the verdict of Article 34 of Law Number 4
2004 on Judicial Power. The Constitutional Court decision also has canceled the provisions relating to the supervision of the judge in Law Number 22 Year 2004 concerning Judicial Commission.

In connection with this, as an attempt to strengthen the implementation of judicial power and to realize an integrated justice system (integrated justice system), then Law Number 4 Year
2004 on Judicial Power as the basis for the implementation of the judicial authorities need to be replaced.


The important things in this Act are as follows:

a. Reformulate systematic Act No. 4 of 2004 on Judicial Power associated with setting comprehensively in this Act, for example, the existence of a separate chapter on the implementation of the principle of judicial power.
b. General settings regarding the supervision of judges and constitutional judges in accordance with the legislation and the Code of Ethics and Code of Conduct of Judges.
c. General settings regarding the appointment and dismissal of judges and constitutional judges.
d. Arrangements regarding the special tribunal which has the authority to examine, hear and decide a particular case can only be established in one of the neighborhoods of the court that is under the Supreme Court.
