The principle of legal protection of the child must be in accordance with the Convention on the Rights of the Child (Convention on the Rights of the Child) which has been ratified by the government of the Republic of Indonesia by Presidential Decree No. 36 of 1990 on Ratification of the Convention on the Rights of the Child (Convention on the rights of Rights of the Child).

Law No. 3 of 1997 on Juvenile Justice for the purpose of protecting and nurturing Children in conflict with the law that the child can meet his future is still long and give a chance to the Son so that through coaching will be obtained identity to become a man of independent, responsible, and useful to oneself, family, community, nation, and state. Thus, the need for a paradigm shift in the handling of Children in conflict with the law, among others, based on the roles and duties of the public, government and other state institutions are obliged and responsible to improve the welfare of the Child as well as provide protection exclusively to Children in conflict with the law.

The preparation of this law is the replacement of the Law No. 3 of 1997 on Juvenile Court (State Gazette of the Republic of Indonesia Year 1997 Number 3, Supplement to the State Gazette of the Republic of Indonesia Number 3668) is done with the aim to materialize justice really ensure protection the best interests of the child who deal with the law as the nation's future.

This Law uses the name Criminal Justice System Children should not be construed as a judicial body as provided for in Article 24 paragraph (2) of the Constitution of the Republic of Indonesia Year 1945 which states that the judicial power is done by a Supreme Court and judicial bodies underneath within the general courts, religious courts, military courts, administrative courts, and by a Constitutional Court. However, this law is part of the general court.
