Notary is a public official who is authorized to make the authentic act in so far as certain authentic deed is not reserved for other public officials. No authentic deed required by the legislation in order to create certainty, order, and legal protection. In addition to an authentic deed made by or in the presence of a Notary, not only because it is required by legislation, but also as desired by the parties concerned to ensure the rights and obligations of the parties for the sake of certainty, order, and legal protection for interested parties as well as for society as a whole.
Authentic document essentially contains the formal correctness notified in accordance with what the parties to the Notary. However, Notary has the obligation to incorporate that what is contained in the Notarial Deed seriously understood and in accordance with the will of the parties, that is the way to read it so that it becomes clear the contents of Deed, as well as providing access to information, including access to legislation related to the parties signatory to the deed. Thus, the parties may determine freely to
agree or disagree with the contents of Deed to be signed.
Legislation governing the Notary that now prevails is still largely based on legislation relic of the colonial Dutch East Indies and partly
the national legislation, namely:
Reglement Op Het Notary ambt in Indonesie (Stb.1860: 3) as last amended in State Gazette Year 1954 Number 101;
2. Ordinance of 16 September 1931 on Wages Notary;
Law Number 33 Year 1954 regarding Deputy Notary and Deputy Notary While (State Gazette Year 1954 Number 101, Supplementary State Gazette No. 700);
Law No. 8 of 2004 concerning Amendment
Law No. 2 of 1986 on the General Court (Gazette
Republic of Indonesia Year 2004 Number 34, Supplement
The Republic of Indonesia Number 4379); and
Government Regulation No. 11 Year 1949 on
Oath / Promise Notary.

Various provisions in the legislation that is no longer relevant to the development and needs of the people of Indonesia.
