Covenant Theory in Muamalah Fiqh

A. Introduction
Assets that are legally owned by a person cannot be used for legal economic transactions if the owner of the assets does not enter into a contract (contract) with a second party (contract partner) which is realized with a consent granted. In the muamalat fiqh study, the contract has rules and provisions, so this brief article will discuss the terms of the contract, the status of the contract in the muamalah, the harmony of the contract, the terms of the contract, the principle of freedom of belief and the limitations of the contract in the muamalah fiqh.

B. Definition of Covenant
In Arabic, the contract comes from the word ‘aqada which means binding. The point is to gather or gather two ends of a rope and tie one of them to the other so that both are connected and become one piece of rope.

The word ‘aqada also means to harden or freeze. Used to express a liquid object that has hardened because it is cooled or heated.2 The word contract in Arabic also means guarantee or agreement.

Whereas a contract in Indonesian is known as an agreement, agreement or contract.4 An agreement means an event in which a person promises to another person or party (individual or legal entity) or an event in which two people or parties promise to commit to an agreement p.5

In terms of Jurisprudence, there are two definitions of the contract according to the scholars, namely the definition of the contract in general and the definition of the contract specifically.
