The Hadith Serial of 5 Marriage Guardians

Marriage as other worship in Islam consists of a number of pillars that must be fulfilled. The pillars consist of the bride and groom, the marriage guardian, two witnesses, and the Ijab and Qabul.

The existence of a guardian is considered as something that helps determine whether a marriage is valid or not. Guardians are defined as people who have power and authority over women or girls who want to make a marriage contract, is one of the pillars in marriage.

There are three groups of people entitled to occupy guardian positions, namely:

a. Nasal guardians, namely guardians who have a kinship with a woman who will marry.

b. Wali mu'thiq, the wali for a slave who had been freed.

c. Guardian judge, that is someone who becomes a guardian in his position as a legal official (judge) or ruler. In this case the authority of the nasab trustees is transferred to the judge, if there is a conflict between the trustees or if the guardian is absent (dead, lost) or because they cannot be present. Then the guardian judge has the right to enforce, except if the women and men who want to marry are willing to wait for the arrival of his absent guardian. In a hadith it says:

"Three cases should not be postponed, namely: prayer when the time has come, the body when it is ready, and the woman when she has found a suitable partner." (H.R. Baihaqi)

Because of the importance of the existence of this wali, to the extent that the Prophet Muhammad said:

Narrated by Zuhri from Aisha that the Prophet SAW said: anyone who marries without permission from his guardian then his marriage is vanity (HR. Ahmad)
