The Statute of Autonomy of the Basque Country of 1979, known as the Statute of Guernica (in Basque, Gernikako Statute), is the institutional norm by which the Basque Country, in expression of its nationality, acceded to its self-government, constituting itself as an autonomous community within Spain.1 Throughout its history the Basque Country has had two statutes of autonomy, the Statute of Autonomy of the Basque Country of 1936, approved in the middle of the Civil War and that could only be put into practice in the province of Vizcaya (since Guipúzcoa and Álava were in the hands of the Francoist side) and that of 1979 (Organic Law 3/1979, of December 18, Statute of Autonomy for the Basque Country), also called "Guernica Statute".

In accordance with the second transitory provision of the Spanish Constitution of 1978, the Basque Country had the requirements to access a provisional autonomy regime that would allow it to prepare a draft statute in accordance with the provisions of article 151 thereof. Furthermore, the first additional provision recognized their "historical rights", which would be updated in the autonomic regime that was intended to be built. However, the requirements of article 151 of the Spanish Constitution would not require the territories to have affirmatively plebiscited their own statutes of autonomy, as was the case in the Basque Country (in addition to Galicia and Catalonia), which He had demonstrated this fact in the approval of its Statute of 1936, the Spanish civil war having already begun (Andalusia will be the only community that avails itself of this road fulfilling such requirements). Thus, the Basque Country agreed to the maximum degree of autonomy set forth in the Constitution (article 151) immediately.
