The Political Constitution of Colombia of 1991 is the Magna Carta of the Republic of Colombia. It was promulgated in Constitutional Gazette number 114 on Thursday, July 4, 1991, and is also known as the Constitution of Human Rights. It replaced the Political Constitution of 1886 and was issued during the presidency of the liberal César Gaviria, with ideas from the also liberal Luis Carlos Galán.
After a hectic constitutional history in the 20th century, Colombia had undergone several reforms adapting to the times and circumstances of the country.

In 1988, a failed political reform that sought to extend citizen participation and avoid administrative corruption, gave rise to a student and political movement that proposed the convocation of a National Constituent Assembly for the 1990 elections, a movement that emerged within the framework of the violence that stirred Colombia during that decade and associated the country's problems with the lack of participation and political inclusion. The demobilizations of the M-19 guerrilla groups (1990), EPL and Quintín Lame (1991), contributed to creating a social environment in which the transformation of the country through political and legal channels was seen as the most promising path.

The movement promoted the Seventh ballot for the 1991 legislative elections, which consisted of introducing an additional ballot during the elections so that Colombians would vote if they agreed to call a National Constituent Assembly to promulgate a new Political Constitution. Therefore, the movement is commonly known as The Seventh Ballot.

The Electoral Council did not accept the official inclusion of the additional vote during the election of the Senate, House of Representatives, Departmental Assemblies, Municipal Council and Mayors, (the Governors were not elected by popular vote until the 1991 Constitution); but the ballot was counted unofficially and the Supreme Court of Justice recognized the majority popular will validating the vote. In December 1990 elections were called to elect representatives to the National Constituent Assembly, which promulgated the new constitution on July 4, 1991.

According to a journalistic note published by Fabio Fandiño and Roberto Vargas, when the new Constitution was promulgated, its articles had not yet been completed and the Secretary General of the Constituent Assembly, Jacobo Pérez, meeting with his entire team, was still checking the veracity of each article to be incorporated into the text of the Constitution. This work would conclude in the first minutes of July 7, 1991.

The presidents of the constituent were Álvaro Gómez Hurtado for the National Salvation Movement, Horacio Serpa for the Liberal Party and Antonio Navarro Wolff for the Democratic Alliance M-19 (political movement that was born from the demobilization of the M-19). In this way, the history of Colombia had an unprecedented turn, since not only was a constitutional change achieved, but also that the M-19 guerrilla group surrendered arms and integrated into national political life, and that indigenous communities were given guarantee representation in the Congress of the Republic.
