The government has basically prepared instruments to protect and regulate manpower in Indonesia so as not to harm various parties, namely workers and the company concerned. One of these instruments is manifested in the Manpower Law, namely Law no. 13 of 2003 concerning Manpower.
As the owner or leader of a company, it is important for us to understand the provisions of this Manpower Act so that we can apply it when hiring or managing employees in companies.
In Article 1 paragraph 2 of the Manpower Law Number 13 of 2003, it is stated that the definition of "Labor is any person who is able to do work to produce goods and / or services both to meet their own needs and for the community."
Meanwhile, the definition of employment is in accordance with Article 1 paragraph 1 of the Manpower Law Number 13 of 2003 that the definition of "Manpower is all things related to labor before, during, and after the work period."
To increase the standard of living, it is necessary to develop various aspects. This includes manpower development which is carried out on the principle of integration through cross-sectoral functional coordination at the central and regional levels. In this case the intention is the principle of manpower development based on the principles of national development, especially the principles of Pancasila democracy, the principle of fairness and equality.
In the implementation of the work relationship process, there are parts that must be followed. The scope of employment itself is pre-employment, the period in working relations, the period of after-employment (post-employment).
"An employment relationship is a relationship between an entrepreneur and a worker or laborer based on a work agreement that has elements of work, wages and orders" and "An employment relationship is a relationship between employers and workers that arises from a work agreement that is held for a certain time but not a certain time. . "
The objectives of the Manpower Law Number 13 of 2003 have several objectives which state that manpower development aims:
1. Empowering and utilizing manpower in an optimal and humane manner
2. Realizing Equitable Job Opportunities and Provision of Manpower in Accordance with the Needs of National and Regional Development
3. Providing Protection to Workers in Realizing Welfare and Improving the Welfare of Workers and Their Families
Whereas the work agreement entered into between a worker / laborer and an entrepreneur all depends on the agreement of both parties. However, with the limitations as stated in this Manpower Law, the work agreement made must show clarity of work between the worker / laborer and the entrepreneur.
The elements of the work relationship that must be fulfilled are:
1. There is an element of service (service)
2. There is an element of time (time)
3. There is an element of pay (wages)
The public in general knows that there should be no unfair treatment (discrimination) between fellow workers or between workers and employers. As stated in Article 5 of the Manpower Law, "Every worker has equal opportunity without discrimination to get a job." and Article 6 of this Manpower Law which reads "Every worker / laborer has the right to receive equal treatment without discrimination from the entrepreneur."
