The background for consideration in Presidential Decree Number 96 of 2020 concerning the Ministry of Cooperatives and Small and Medium Enterprises is as a follow-up to the establishment of the Ministry and Cabinet of Advanced Indonesia for the Period of 2019-2024 and to implement the provisions of Article 11 of Law Number 39 of 2008 concerning State Ministries, it is necessary to stipulate a Presidential Regulation concerning the Ministry of Cooperatives and Small and Medium Enterprises;
The legal basis for Presidential Decree Number 96 of 2020 concerning the Ministry of Cooperatives and Small and Medium Enterprises is:
1. Article 4 paragraph (1) and Article 17 of the 1945 Constitution of the Republic of Indonesia;
2. Law Number 39 of 2008 concerning State Ministries (State Gazette of the Republic of Indonesia of 2008 Number 166, Supplement to the State Gazette of the Republic of Indonesia Number 4916);
3. Presidential Regulation Number 60 of 2012 concerning Deputy Ministers (State Gazette of the Republic of Indonesia of 2012 Number 129) as amended by Presidential Regulation Number 134 of 2014 concerning Amendments to Presidential Regulation Number 60 of 2012 concerning Deputy Ministers (State Gazette of the Republic of Indonesia of 2014 Number 272);
4. Presidential Regulation Number 67 of 2019 concerning Structuring of Duties and Functions of State Ministries of the Advanced Indonesian Cabinet for the Period of 2019-2024 (State Gazette of the Republic of Indonesia of 2019 Number 202);
5. Presidential Regulation Number 68 of 2019 concerning State Ministry Organization (State Gazette of the Republic of Indonesia of 2019 Number 203).
