BOOK I: PROVISIONS COMMON TO ALL OFFENSES
PRELIMINARY PROVISIONS
Article 1
The provisions of this Book apply to all offenses except contrary legal provision.
Article 2
It is an offense any fact or omission, which disturbs or is likely to disturb the order or peace
Public prejudicing the legitimate rights either private individuals or public or private authorities and
which as such is legally sanctioned.
Article 3
The offense is qualified:
1o Crime:
If she is liable, either the death penalty or a sentence of perpetual or greater freedom to 10
years ;
2o Violation:
If it is punishable by deprivation of liberty or less equal to 2 months and a fine worth less
or equal to 360,000 francs or one of these penalties;
3o Offense:
If she is liable to a custodial sentence or a fine other than the above.
Article 4
The nature of the offense within one of the categories set out in section 3 above, do not change when
by the set of rules on recidivism, excuses or extenuating circumstances, the penalty is
those relating to another category.
Article 5
The offense is punishable by penalties and possibly by security measures.
The penalty is to the repression of the offense and shall be to the amendment of its author it
sanctions either in his person or his property or his rights or his honor.
The security measure seeks to prevent by suitable means any breach by a
person who presents a certain danger to society because of its tendency to delinquency.
Article 6
The penalty is primary when it is the essential punishment of the offense.
It is complementary when assistant to the principal penalty.
Article 7
The additional penalties and security measures are mandatory or optional.
Article 8
Penalties and security measures of any kind must be expressly ordered. Nevertheless
additional penalties and security measures when they are required to automatically apply
as a consequence of the principal penalty, even if the judge failed to pronounce them.
Article 9
The main penalties are divided into criminal sentences, correctional and misdemeanor:
- are criminal, besides the death penalty, all custodial sentences at or above 5 years
is pronounced for qualified crime;
- Are misdemeanor, penalties imposed is qualified contravention;
- Are all other correctional sentences.
Article 10

Article 11
